Alito’s Dissent Exposes a Judicial Coup Supreme Court is Threatening Trump and the GOP

A bombshell dissent from Justice Samuel Alito, joined by Justice Clarence Thomas, has unveiled a shocking overreach by the Supreme Court, dubbed a “judicial coup” against President Trump and representative government. In a midnight ruling on April 19, 2025, the Court used the All Writs Act to block the government from deporting a “putative class” of noncitizens targeted under Trump’s March 2025 Proclamation invoking the Alien Enemies Act against the Tren de Aragua gang. Alito’s dissent exposes procedural violations, jurisdictional oversteps, and a dangerous precedent that could cripple the GOP’s agenda—especially if Democrats seize the House in 2026.


Supreme Court lacks Jurisdiction

Alito’s dissent details a laundry list of judicial missteps. The Court lacked clear jurisdiction, as the All Writs Act doesn’t grant new authority, and the Fifth Circuit ruled it had no jurisdiction over the petitioners’ appeal. The petitioners bypassed proper procedure, giving the District Court a mere 45-minute ultimatum on Good Friday before appealing. The Supreme Court rushed in, issuing its order without hearing from the government, ignoring the Fifth Circuit’s ongoing review, and providing no explanation. Alito calls this a reckless power grab, noting the lack of evidence for imminent deportations and the unprecedented use of class-wide relief in a habeas case.


This “judicial coup” directly undermines Trump’s authority to enforce immigration law, a cornerstone of GOP policy. The Tren de Aragua gang, linked to violent crime, poses a real threat, yet the Court’s ruling halts Trump’s efforts to protect Americans. Alito warns that such judicial activism threatens the separation of powers, allowing unelected judges to override the elected Executive Branch. This isn’t just about immigration—it’s a blueprint for courts to block GOP initiatives on borders, security, and beyond.


The stakes skyrocket with the 2026 House election looming. If Democrats take control, as many fear, they could amplify such judicial overreach, using their majority to shield activist rulings and launch investigations to paralyze Trump’s administration. Democrats’ own authoritarian tactics—censorship, mandates, and targeting dissenters—already mirror the judiciary’s overreach here. A Democratic House would embolden both, leaving the GOP powerless to fight back.


Alito’s dissent is a clarion call: the judiciary must respect its limits, and the GOP must rally to protect representative government. If Republicans don’t strengthen their ground game and hold the House, this judicial coup could be the first of many, handing Democrats and activist courts the tools to dismantle Trump’s agenda. The battle for 2026 just got fiercer—America’s future hangs in the balance.
